I did a quick Google search, and the top hits were for some company that apparently makes ballpoints (possibly for custom imprints for businesses and such).

The modern Conklin company has a model called the Empire but that is probably not what you are looking for.

Back in the 1920s Conway Stewart made several models whose only barrel imprint was "The Empire Pen."  There is some information in this thread:

Thank you, kestrel - that is an informative link (and thread)

 

Given the evidence presented in the thread, I'd say the nail has pretty much been hit on the head - made for the Boy Scout organisation as Empire pens, in the 1920's - 30's by CS.

 

Of course, as with all sketchy history, I am prepared to be corrected.
