Bad Transaction Experience With Ebayer Toshi_G

I just had very bad transaction experience with one ebay seller, toshi_g .

 

I bought two fountain pens from him in Aug. One is Nakaya, the other is platinum.

The platinum fountain pen is urushi pen, according to the platinum co. catalog, issued in 1975, retail price was JPN10000(in 1975). I was happy when I won the auction, because this fountain pen is new, and the price is good.

 

I got both fountain pens on Aug 20, I was very disappointed. Both pens are used.

The condition of Nakaya briar fountain pen is acceptable. But the platinum fountain pen, name-engraving on the section(Japanese name, Kato Kaori[Kaoru], on the other side that he didn’t took photo), some abrasion, one small cut wound on the barrel.

Ok, this platinum fountain pen is rare, maybe someday I might find one new nib/section for it. So I asked the seller if he can give me partial refund? The answer was no.

 

Fine, I decided to send the platinum fountain pen back. I asked the seller, Does full refund include my shipping fee from Hong Kong to USA?(because he lied in the description of the pen.) The answer was as below

 

“Returns Policy

Your satisfaction is our first priority.

No replacement or refund will be made.

No returns accepted."

 

You saw high quality pictures of the pen and we sent it without damage.

I still offered you the refund because my boss really like this pen and He wanted to keep it. He was sad when you bought it.

So I'm still giving you the opportunity to refund the pen.

For the shipping cost please read our refund policy at the ebay page. You can find there who pays the return shipping cost."

 

 

You said the pen is new, but this pen is second-hand with name-engraving.

Then you give me the opportunity to refund the pen!!!!

YOU CHEATED ME, THEN YOU GIVE ME THE OPPORTUNITY TO REFUND THE PEN!!!!

 

Such words really made me angry.

Should I say “thank you, God, thanks for giving me the opportunity to refund the pen”?

 

No, nobody can cheat others first, then speak loudly.......I give you the opportunity.......

 

If this guy really wants to do apology, refund me half(platinum pen).

His answer was NO.

 

Then he confessed that he bought this pen from ebay, he doesn’t know the Chinese words, he thought such name-engraving is original!(hey, man, you are a pen-seller!!)

 

Bought 2nd-hand pen, but sold it as NEW. IT IS REALLY GOOD PEN BUSINESS.

So I left the negative feedback(for this platinum fountain pen)

 

 

Take care if you want to buy fountain pen from this toshi_g.

You need to file a dispute with eBay for a full refund. The pens were misrepresented.

I am so angry with what toshi_g told.

I give you the opportunity to refund the pen!!!!

 

Many pen businessman bought pens from ebay, then re-sell them.

But I have never met such dishonest and rude seller,

 

Should I trust this guy again? If I send the pen back, he says "oh, the pen is damaged, or the parcel is lost, so I refuse to refund you."

 

(bleep) thing might happen.

File the dispute with eBay and include ALL the information. Include pictures, if you can, and include all the details regarding the condition of the pens that you received. By filing the dispute, the seller is bound by the resolution -- hopefully, a full refund including shipping -- and eBay can make sure that you get your money.

 

Filing the dispute adds to the sellers record as well. If the seller has misrepresented items in the past and continues to do so after this, the seller can be removed from eBay.

I feel your pain. I would not risk sending the pen back to the seller who does not even have a basic decency in communication. Ebay/paypal will need signature confirmation when you return the item and many times the postal service can slip up leading to your loss and seller will claim to ebay/paypal that they never received the item, has happened with me.

 

The world has its share of crook sellers and crook buyers. both types of crooks are there.

 

I am a buyer as well as a seller on ebay. Recently, a buyer complained that the sold item(new) did not work, I took another new piece from my stock, tested it for two weeks fully before sending it out FOC even when the buyer had not returned the first one. The buyer received the second one as well, never bothered to even attempt to return the first one, shamelessly kept both the pieces for the price of one and rewarded me with a negative for being trusting and a fool. Never again...

The pen you got is not as described. It doesn't matter what the seller's return policy is. If the facts (and the pictures) are as you say, you'll win and eBay will return your cost plus shipping. It's a simple process that works very well and keeps you out of a back-and-forth with the seller.

The seller just filed the ebay dispute, wanted to cancel the transaction.

Sorry you had such a bad experience. I have opened cases with eBay when necessary and have always been pleased with the outcome. If it was truly this misrepresented, you should have no problem getting reimbursed.

Despite the cost, PLEASE be careful to use signature confirmation (signed-for) and insurance when shipping the pens. Since the seller is prone to misrepresentations, you must protect yourself. This will provide proof of when the seller receives the pens.

 

Make sure that you enter the tracking number and insurance number on eBay as part of the dispute.

Because I have no such experience, I didn't ship the pen, and I haven't received the refund yet.

The pen should only be sent as part of a dispute filed by the BUYER as this seller CANNOT be trusted. The buyer's dispute should not be closed until the buyer has a full refund including shipping.

If you want, call eBay and ask them some of the questions you're asking us. Their phone help is weird--you have to call them and leave a message and then they call you back--but I've always gotten a call-back within a few minutes. Actually, sellers CAN initiate cancellations of transactions on eBay. In addition, they can choose the description as the reason for canceling the transaction. The transaction fee for a listing is refunded to the seller by eBay if the seller cancels the transaction with the agreement of the buyer; the seller can, then, relist and sell the item without paying the transaction fee twice. I had a seller do that last year when she misrepresented a Dunhill pen on eBay, and it was at that time that I learned about the seller's not having to pay the transaction fee if the transaction is canceled.

 

eBay looks at the seller filing a dispute for the return of the item as the seller's making a mistake and admitting to the mistake. Sellers do not file cancellation of transaction disputes ONLY to give credits when items are no longer available! A seller CAN file a cancellation of transaction dispute because her/his item was not-as-described. I had called eBay Customer Service to inquire about the seller's dispute -- FYI actually referred to as a request -- to cancel the Dunhill pen transaction last year: it was from the eBay Customer Service representative that I learned about the transaction fee refund to the seller (as mentioned) as well as such a request to cancel a transaction as being looked on as a lesser offense than a buyer-initiated dispute.

 

FYI: Look up the question "I closed my cancel transaction case. When will I get my final value fee credit?" in the eBay help system for verification that sellers are refunded transaction fees for canceled transactions.

 

VERY IMPORANT FYI: Read about seller-cancellation of trasactions at http://pages.ebay.com/help/sell/cancel-transaction-process.html to see that making a "mistake when listing the item" is an eBay-acceptable reason for requesting to cancel a transaction.

BE CAREFUL! Declining the seller's request to cancel the transaction WITHOUT having filed your own dispute may make it impossible for you to file a dispute at all.

 

I STRONGLY urge you to read about seller's requests to cancel transactions at http://pages.ebay.com/help/sell/cancel-transaction-process.html as this provides evidence that a seller can request to cancel a transaction due to a "mistake in the listing". After that, you can contact eBay Customer Service for guidance (if desired) on how to proceed BEFORE you do anything about the seller's request to cancel the transaction.

 

Keep in mind that if you state as your reason for declining the seller's request to cancel the transation that you are going to KEEP the pen then you must KEEP the pen -- returning the pen will NOT be an option at that point as you will have stated via the eBay system that you are going to keep the pen! There are not multiple reasons available as responses for a dispute or a request to cancel a transaction -- other than accepting a partial refund, you are either KEEPING or NOT KEEPING the item. Once you state that you are KEEPING the pen, you cannot file a dispute to RETURN the pen or to demand a partial refund! Disputes do not work that way!

 

Again, please be careful not to close the seller's request to cancel the transaction by refusing to return the pen as this means that you are keeping the pen; read about requests to cancel transactions at http://pages.ebay.com/help/sell/cancel-transaction-process.html as this provides the steps that sellers must follow.

 

BEFORE responding to the seller's request to cancel the transaction:

(1) you may TRY to initiate your own dispute but the eBay system may not allow you to do so since the seller has initiated a request to cancel the transaction; then

(2) CALL eBay Customer Service if the eBay system will not allow you to initiate a dispute and discuss how to proceed; customer service may direct you to http://pages.ebay.com/help/sell/cancel-transaction-process.html to read about seller-requests to cancel transactions. If the eBay system will not allow you to initiate a dispute (BEFORE responding to the seller's request to cancel the transaction) then you must use the seller's request to cancel the transaction to get your money back.

 

In the end, it truly does not matter who initiates the request to cancel or dispute for the transaction as you want to return the item and receive a full refund. Keep in mind that if the full refund comes as a result of a request to cancel the transaction initiated by the seller or a dispute filed by you (the buyer), the desired outcome (a full refund) will have been achieved.

 

NO MATTER WHAT, when returning the pen -- only when directed to do so via the eBay Resolution Center process -- make sure that you use signature confirmation (signed-for) mail with a tracking number and insurance. You must enter the tracking number and insurance number into the eBay system as part of the Resolution Center process. eBay will track the return of the pen just as you will and this provides the necessary EVIDENCE that the pen was returned to and received by the seller.

 

And again, DON'T SEND ANYTHING until eBay tells you to.

Disputes have well-defined steps, one of which is the return of the item BUT ONLY when stated through by eBay through the Resolution Center process.

 

You can use the eBay Online Customer Support http://ocsnext.ebay.com/ocs/home? to look up information (and ask questions) about the Resolution Center, the Resolution Center process, disputes, and seller-requests to cancel transactions.

The actual listing had a no return policy that the buyer, elvishsiang agreed when he bought the pens.

 

I didn't know about the meaning of the engraved Chinese characters, since I don't read Chinese I thought that it is Original engraving. (I bought the pen from ebay as it is)

 

Unfortunately elvishsiang told me about that it is a name engraved in the pen and it is obviously used.

He wanted me to send him back $100 as a compensation.

 

I can't do partial refund so I apologized and told him to send back the pan and I will give him a FULL REFUND!

As you can see I started the transaction cancellation because that's how you can make sure to get the money back when I received the returned pen.

 

I agree that I made a mistake and I apologize again.

I'm still looking forward to return the pens or just one, up to you.

 

By the way I had a really hard time to communicate with elvishsiang, one day he wanted a partial refund and then the next day he wanted a full return and refund and then the next day he wanted to keep them and the next day he said that he have to call paypal and ebay first about how to resolve this issue and how to send me back the pens etc... He still didn't get back to me.
