1, The Trademark Era, and the Ur-Trademarks,

The trademark era in the US started on Oct 25, 1870 when the first US trademark was issued, trademark no. 00001 for Averill paint. Before this, however, trademarks were sometimes issued as designs, such as US design nos. 1,230 and 2,063. But the first trademark for a writing instrument in the USPTO was trademark no. 00019, Eberhard Faber's use of the word "Star" on "Lead-Pencils", issued on Nov 1, 1870, but used since the summer of 1861. There are ten other trademarks up to 1917 that use either the word "star", or star imagery, but not including the "Montblanc splat" in Topic 1812 on L&P, the one that started off as UK patent no. 13,900 from 1907 and later became the Montblanc splat.
